Policies

Terms of Use
This document states the rules that govern the use of the Ticketspot.com website by you. Herein, rules will be referred to as "Terms," Ticketspot.com website will be referred to as "Site," and you will be referred to as "User." The User agrees that by visiting and/or using this Site that the User expresses agreement to be bound by these and the following Terms and to be bound to all laws and regulations that may apply. TicketSpot.com reserves the right to amend the Terms at any time. New Terms will be effective the moment that such changes are posted to the Site.

Sales
Sales are final. Due to the unique quality of individual tickets, there are no exchanges, refunds, or cancellations. In the instance of event postponement, the original tickets will be honored on the rescheduled date. Refunds will only be granted for cancelled events that are not rescheduled if the User requests a refund from the Site. It is the User's obligation to request a refund within a reasonable period of time. The Site may require that the User returns cancelled tickets to the Site at the User's expense before issuance of a refund will be made. Shipping and handling charges are nonrefundable. Refunds or exchanges will not be granted for lost, stolen, or damaged tickets. It is the User's obligation to safeguard tickets once received. Natural conditions such as heat or sunlight may damage tickets. Rarely tickets that are purchases may no longer me available. In this instance, if the User has agreed to be automatically upgraded, tickets of equal or greater value, as deemed by the Site, will be issued at no additional cost to the User. The User will be notified of new seat locations by the Site. The User's credit card will be charged for the new seats. If the User has not agreed to be automatically upgraded, the Site will contact the User to discuss alternative seating solutions. If User has accepted new seats, only then will User's credit hard be charged by the Site. To prevent fraud, the Site may require the User to provide proof of identity before processing the order. What constitutes proof of identity will be deemed by the Site.

Shipping
Orders will only be shipped to the billing address of the User's credit card. Normally, orders are shipped on the date of purchase. If an order is placed outside of business hours, it will be shipped the next business day. Sometimes orders cannot be shipped immediately because tickets are not yet physically available. In such an instance, orders will be mailed as soon as tickets become available. Purchasing expedited shipping does not mean that such orders will shipped immediately. All shipments will require the User's signature as proof of delivery. Users wishing to place orders outside the United States must select an international shipping option. If User fails to do so, the Site will adjust the shipping cost at international rates. The Site reserves the right to charge an additional fee, amount deemed necessary by the Site, if User provides a shipping address that makes delivery confirmation impossible. This fee will pay for the added risks involved with this type of shipment. The Site will notify the User of added fee before order confirmation. The Site also reserves the right cancel any such orders. In this instance, the Site will also contact the User.

Pricing
This Site is not a box office and does not have affiliation to any box offices, venues, or performers. Tickets are sold in some cases above their face value. The Site does not act as a primary box office, but rather sells tickets within the secondary ticket market. The Site cannot confirm pricing until after the User has placed an order. In extremely rare cases, tickets are accidentally listed beneath their actual value. The Site reserves the right to adjust prices before order confirmation in such an instance. The Site will never charge the User's credit card until after contacting and receiving approval from the User. Listed prices may not include local, state, and federal taxes that may apply. All prices are listed in United State Dollars.

Use
Site content and software is owned exclusively by the Site and is protected by U.S. and international copyright laws. User is only authorized to view and retain portions of the Site for personal use, which includes purchasing tickets for personal use. User is prohibited from retaining any portion of the Site by any means of preservation, modifying any portion of the Site by any means of modification, and publishing any portion of the site by any means of publication unless for personal use, which includes purchasing tickets for personal use, or unless otherwise specifically authorized by the Site. User Violations The Site reserves the right to, without prior notice, terminate User's access to the Site, cancel User's order, or seek legal remedy if User Violates the Terms of Use as stated here. Monetary damages may not be sufficient remedy for the Site in the event of a User violation. User will be subject to injunction or other equitable relief in such an instance. The Site may release User information if required by law or if needed to address activity that is illegal or violates the terms of use. The Site will not provide refunds or exchanges to Users in violation of the Terms.

Copyright Policy
The Site and its software, including without limitation all text, graphics, filed, applets, scripts, logos, buttons, icons, images, audio clips, programs, and other works are copyrighted works of the Site. All Rights Reserved. Unauthorized reproduction or redistribution of any copyrighted item on the Site is prohibited. TicketSpot, TicketSpot.com and www.TicketSpot.com are protected marks of the Site. The Site reserves the right to at anytime terminate use of any User who unlawfully transmits or receives copyrighted material from the Site.

Disclaimers
The Site makes no guarantee that it will be free of error or provide specific results for any area of content such as links or search results. The Site makes no guarantee that it will operate free of interruptions. Site content is delivered on an "as-is" basis only. The Site makes no guarantee that files accessed or downloaded by the User from the Site are free of viruses or any other destructive content. The Site disclaims all express or implied warrantees, including implied warrantees of merchantability or fitness. The Site will not be liable for any damages arising from any use by the User. Damages the Site will not be liable for include but are not limited to direct, indirect, incidental, consequential, special, and punitive. The Site disclaims liability for any and all damages based on breach of contract, breach of warrantee, tort, negligence, product liability, or otherwise even if forewarned of potential damages. All disputes between Site and User will be resolved according to the laws of the state of incorporation of the Site without regard for that state's conflict of law provisions. User agrees to personal jurisdiction by venue in federal and state courts of the state of the Site's choosing. User agrees to not hold the Site, its officers, and its agents responsible for any loss, liability, claim, demand, or reasonable attorney's fees made by a third party to the User as a result of any use of the Site by the User. User agrees to indemnify third party. User must register with the Site in order to place an order. The registration process involves the User providing valid personal information which includes but is not limited to name, address, and credit card number. Access to the Site will be revoked from Users who provide false information. In order to register, User must be over the age of 18.

Privacy
The Site will not provide the User's personal information to third parties unless by the User's request or by legal requirements such as court order or subpoena. The Privacy Policy in not applicable to companies or individuals that the Site has no control over such as credit card companies. The Site may track User's IP address when accessing the Site. The Site may also use "cookie" files. Both IP tracking and "cookie" use are for the sole purpose of maximizing the User's experience of the Site. The Site reserves the right to change privacy policies at any time. In this instance, the Site will either notify the User of such changes by email, or simply post the changes to the Site.
